CBP's CAPE (Consolidated Administration and Processing of Entries) processes IEEPA refund claims through the ACE Secure Data Portal.
80-Day Window Is Closing
Entries liquidated more than 80 days ago are NOT eligible for Phase 1. Example: an entry liquidated February 15, 2026 loses eligibility around May 6, 2026. After that you'll wait for Phase 2 (no timeline) or pursue CIT litigation.
Phase 1 Eligibility
- Unliquidated entries
- Entries within 80 days of liquidation
- Suspended, extended, or under-review entries (incl. warehouse)
- Refund includes IEEPA duties + accrued interest
Excluded from Phase 1
- Entries with drawback claims (Type 47)
- Entries flagged for reconciliation (Type 09)
- AD/CVD entries with DOC liquidation instructions
- Chapter 98 HTSUS entries
- Fully liquidated more than 80 days ago
- Duty paid by surety, not importer
Who Can File
- β Importer of Record (IOR): file directly through your ACE Portal
- β Authorized customs broker: only the broker who filed your original entries
- β NVOCCs, freight forwarders, and 3PLs cannot file CAPE Declarations on your behalf
- β No ABI or other third-party filing allowed
- β’ Max 9,999 entries per CAPE Declaration β multiple declarations allowed
- β’ ACH refunds must be enabled in your ACE Portal account
What to Do Now
- 1Open an ACE Secure Data Portal account (Importer sub-account required) if you don't already have one
- 2Enroll in ACH refunds with a refund-specific bank account
- 3Compile entries with IEEPA HTS codes (9903.01.xx or 9903.02.xx)
- 4Coordinate with the customs broker who filed your original entries
- 5Submit your CAPE Declaration CSV through the ACE Portal
